COVID-19, Enterprise Software Licensing and Audit Defense: What to Expect, What Pitfalls are Coming and How You Can Protect Your Company

Thursday, September 10, 2020

12:00 pm – 1:00 pm Eastern Time

The global pandemic, the resulting stay-at-home orders and the creeping recession is causing unpredictable and lasting changes in how businesses rely upon their Enterprise Resource Planning (ERP) software. Unfortunately, the abrupt manner in which many businesses were forced to put in place these radical changes left little time to ensure compliance with licensing obligations.  With well-known software vendors such as Oracle or SAP waiting in the wings to launch auditing campaigns to shore up revenue streams, it is essential for businesses to take proactive measures to shore up their licensing entitlements and ensure their deployments are covered.

In this presentation, Art and Joel will provide context for the coming wave of software audits and explain how companies can best anticipate and protect their assets in the uncertain months and years to come.

Speakers:

Arthur S. Beeman, Beeman & Muchmore LLP

CIOReview names LicenseFortress Top Company in License Management – 2020

“Don’t bring a knife to a gunfight,” is how Michael Corey, co-founder of LicenseFortress, advises companies that are going to get audited by their software vendors. Conducting license compliance checks for over ten years, Corey has witnessed several instances where companies fail to understand software licensing nuances and lack knowledge around license metrics pertaining to software deployment, usage, configurations, and cloud architectures. Such blind spots are why software vendors like Oracle, IBM, and Microsoft find software audits an easy way to generate additional revenue.

COVID-19, software license audits, and patent litigation

Arthur S. Beeman and Joel T. Muchmore of Beeman and Muchmore LLP look to the horizon and ask: how can you protect your business?

It is inevitable that the fallout from the Covid-19 pandemic will draw opportunists. Due to peculiarities unique to the resulting economic fallout, we are seeing this truism in play in the world of intellectual property monetization. Particularly with regard to patent litigation and software license audits, the pandemic will likely increase certain very real threats to companies of all sizes and industries. This means that while businesses are preserving a solvent bottom line, in-house counsel must protect their clients against attacks from emboldened software vendors and patent litigators.

Facebook, Cambridge Analytica, and Data Privacy at a Turning Point

Industry leader Michael Corey, LicenseFortress Co-Founder, weighed in on on the news unfolding about an app that was able to gather 50 million Facebook users’ data that was later resold to a political data firm in order to try to influence American voter sentiment. “Why is anyone surprised by these revelations? Corporate America has had a habit of violating laws, getting caught, and paying the fines out of petty cash so who wouldn’t want  to make hundreds of millions of dollars to pay a fine of a few million? Clearly, the FTC does not have a habit of making sure that the fine fits the crime.”

LicenseFortress Launches as Standalone Company to Ensure Enterprise Software License Compliance

LicenseFortress has launched as a standalone entity to focus on database software license management and audit protection service with a financial guarantee.

Originally part of VLSS, a consultancy founded in 2005 with a focus on Oracle and VMware technologies, LicenseFortress was spun out as a standalone company in October 2017.

“About three years ago we realized that customers were coming to us over and over again about licensing questions and as a result we rolled out the LicenseFortress product in February 2016. We have been releasing iterations of it since that time, and then in October 2017, we formally separated out the company,” said LicenseFortress co-founder and CEO Dean Bolton.

Understanding VMware Licensing with Oracle

Over the last decade, VMware virtualization has become a preferred platform for hundreds of thousands of customers, many of them running their business-critical applications on the virtualized infrastructure.

At the center of many of these BCA environments is the Oracle Database Management System. However, there is still a significant amount of confusion regarding how to properly license Oracle software in those VMware environments.

In a recent DBTA webinar a roundtable of experts, including Don Sullivan, product line marketing manager for business critical applications and database for VMware, Dave Welch CTO and chief evangelist at House of Brick Technologies, Daniel Hesselink managing partner at License Consulting, and Dean Bolton, president of VLSS, discussed how to properly adhere to contracts, as they exist presently and are available publicly, to correctly license Oracle on virtualized infrastructure.

Straight Talk on Oracle on VMware Licensing in 2017

At the center of many of these BCA environments is the Oracle Database Management System. Unfortunately, it is often the case, that significant confusion regarding how to properly license Oracle software in those VMware environments dominates the discussion distracting from what should be the main focus of the proposition. That is, the tremendous value of combining the world’s premier RDBMS with the world’s premier virtualization platform.
